Terms of use
These terms govern the use of Uttek Jam (uttek.de/jam), a free platform where musicians create songs together. The provider is Rüdiger Ude (see Legal notice).
1. Scope and agreement
By registering you enter into a free user agreement with the provider on these terms. There is no entitlement to registration or to any particular availability or feature; the platform may be changed, restricted or discontinued at any time.
2. Minimum age and account
You must be at least 16 years old. Each person may have only one account. Your details must be truthful; keep your password secret. You are responsible for activities via your account insofar as you are at fault.
3. Your content and rights
You keep all rights to the content you upload (audio, texts, images, video links, events). You may only upload content for which you hold the necessary rights – in particular to compositions, lyrics, recordings, samples and images – and which does not infringe third-party rights (e.g. copyright, neighbouring rights, trademarks or personality rights). Covers and adaptations of other people’s works are only allowed if the rights have been cleared.
4. Licence to the platform
So that Uttek Jam can work, you grant the provider a simple (non-exclusive), free, worldwide right to store your content on the platform, reproduce it, adapt it technically (e.g. image size, audio format), make it publicly available and play it, and show it in previews (e.g. home page, charts, teaser images for social networks). The right ends when you delete the content or your account; technically necessary copies in backups are overwritten on a regular cycle. The provider does not exploit your content outside the platform (e.g. sale, publication on other services).
5. Shared songs (playing along)
On Uttek Jam others can add tracks to your song and you can contribute tracks to other people’s songs. This simple rule applies:
- Everyone keeps the rights to their own contribution (song idea/base track or own track).
- Anyone who uploads a track to someone else’s song allows the song’s creator and all other contributors to have the track played and listened to mixed together with the song on Uttek Jam. Conversely, the song’s creator allows the song to be combined with other people’s tracks.
- Any use of the combination outside Uttek Jam (e.g. release, sale, streaming services, competitions) requires the consent of everyone whose contributions are included. Please agree on this beforehand, e.g. by message.
- The song’s creator may remove other people’s tracks from the song. You can delete your own track at any time.
- If a song is deleted (including through account deletion), all tracks it contains are deleted too. Keep your own files safe yourself.
6. Prohibited content and conduct
In particular, the following are not allowed:
- illegal content, copyright infringements and content without the necessary rights;
- hate speech, incitement to hatred, glorification of violence, threats, insults, harassment and bullying;
- pornographic content, content harmful to minors or sexualised content involving minors;
- violations of personality rights, e.g. photos or data of third parties without permission;
- spam, advertising unrelated to music, chain letters, phishing, malware;
- impersonation, multiple or fake accounts, manipulation of likes, plays or charts;
- attacks on the technology, automated scraping or circumventing bans.
7. Reporting content (Art. 16 DSA)
Anyone can report content they consider illegal or in breach of these terms via “⚑ Report” or the report form. A report should contain: the exact address (URL) of the content, an explanation of why it is illegal, name and email address (except for certain offences against children) and a confirmation that the information is accurate and complete to the best of your knowledge. I confirm receipt, review reports promptly, diligently and objectively, and inform the reporting person of the outcome.
8. Moderation, suspension and statement of reasons
In the event of violations, the provider may hide or delete content, restrict features or suspend accounts temporarily or permanently, taking into account severity, frequency and intent. Those affected receive a statement of reasons (Art. 17 DSA) insofar as an email address is known and no legal obstacle applies. You can object to decisions within six months via the contact form; objections are reviewed by a human. Anyone who repeatedly posts manifestly illegal content or submits manifestly unfounded reports may be suspended for a reasonable period after a prior warning (Art. 23 DSA). No automated moderation takes place.
9. Liability
Use is free of charge. The provider is liable without limitation for intent and gross negligence, for injury to life, body or health and under the Product Liability Act. Otherwise liability is excluded, in line with §§ 521 and 599 BGB for gratuitous services. There is no entitlement to permanent storage; please keep copies of your files yourself. The provider is liable for user content only under the statutory rules for hosting providers.
10. Indemnity
If you culpably infringe third-party rights through your content, you indemnify the provider against resulting third-party claims, including reasonable costs of legal defence.
11. Termination and account deletion
You can end the agreement at any time by deleting your account under Account & data. The provider may terminate the agreement with two weeks’ notice, or without notice for good cause (e.g. serious or repeated violations). You can export your data before deletion.
12. Founding members
The first 100 accounts whose email address has been verified (excluding demo accounts) receive the status “founding member” with a sequential number. Founding members may use all future paid features of Uttek Jam free of charge for as long as their account exists. The status is tied to the account and is non-transferable. It ends when the account is deleted or banned for violating these terms. More: Founding members.
13. Changes to these terms
Changes are announced on the website at least two weeks in advance. If you do not object within that period and continue to use the platform, the changes are deemed accepted; the announcement will point this out. In case of objection, either party may end the agreement.
14. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection rules of your country of residence remain unaffected. The German version of these terms is authoritative; translations are for information only. Should any provision be invalid, the rest remains valid.
